As you read this Affidavit of Facts, presented to remove three young boys from their home, Note how many times the Regina Lenoir writes, "do not know." It appears that Lenoire "does not know" and her lack of awareness has kept three children in state foster care limbo since 2007. One child has neither seen nor heard from anyone in his family. He has no clue what is going on and Tiffany Denson has made clear that SHE wants Christopher adopted. Christopher does not want to be adopted but I feel certain if convinced that he will never go home, he will finally give up. CPS has been messing with this child since he was seven years old, SIX years ago.
What is more bewildering is how a Judge determines this affidavit meets the minimal requirements of child abuse or neglect. Reasoning is UNKNOWN!~

AFFIDAVIT: Mother does not seem to try to control the children. They roam the streets at will.
FACT: Children do not roam the streets at will.
FACT: EVERY therapist who has worked with the family, have told mother she did the right thing in controlling her children.
FACT: CPS places children in dangerous living environments.
FACT: Children are abused in foster care.
FACT: Two children have been raped in foster care!
FACT: CPS cannot control children.
AFFIDAVIT: The older sister is pregnant and it is unknown if the child is receiving prenatal care.
FACT: Older Sister’s Ob/Gyn is Dr. Womack from Women’s Institute of HealthCare.
AFFIDAVIT: Yesterday Dustin had eczema like rash on the back of neck.
FACT: Dustin has been diagnosed with eczema since 2 months of age.
FACT: School has repeatedly made this an issue and mom carries a diagnosis in her purse.
AFFIDAVIT: A sibling has been the perpetrator of sexual abuse but the name of his victim was unknown to the caller.
FACT: CPS kept custody of older brother from age 14 until immediately prior to 18th birthday.
FACT: This is a matter of court record. Sibling has completed numerous therapies including but not limited to, Pegasus RTC for over one year and continues in therapy with Mr. Hebert.
AFFIDAVIT: Andrew was sexually abused by his older brother who is now in CPS custody.
FACT: Older brother has not been in the home for four years, while in CPS custody.
FACT: Andrew, Dustin, and Kristopherson are only children in CPS custody.
FACT: Andrew has addressed these issues in family therapy with sibling.
AFFIDAVIT: Mother wants this brother to return home.
FACT: This is mother’s child and had been dealt with in Northern state of residence
FACT: Therapist, Mr. Jay Hebert, is in agreement.
FACT: DFPS asked Judge Montemayor to return brother on 9/14/07, and to close the case.
FACT: Judge Montemayor sent brother home on 9/14/07; and allowed CPS to take siblings from their school using this Affidavit of nonsense.
FACT: Attorney, Eric Sutton, recommended brother sent home on 9/14/07.
AFFIDAVIT: There are two large dogs in the home which reek of urine and feces.
FACT: There are three dogs, one is a Katrina Rescue and is large,
FACT: The home has never reeked of urine and feces.
AFFIDAVIT: Mother has covered doorway to living room with sheet so that visitors can only see the hallway inside the front door.
FACT: Grandmother uses the formal living room as her private bedroom.
FACT: Grandmother put sheets up to allow for privacy until walls could be built.
AFFIDAVIT: She does not let anyone inside.
FACT: Mother did not allow Regina Lenoir in home as per her civil right to be left alone in her own home; family was eating dinner.
FACT: Caseworker, Benjamin Gutierrue was in home twice, 07/2007 & 09/2007.
FACT: Caseworker Kathryn Avila and Ada Gomez were in home during therapy sessions until Judge Montemayor ordered them to stay out of therapy sessions, on or about August 29, 2007.
FACT: Therapist, Mr. Hebert, is in the home every week.
FACT: Advocate, Joanna Wright, has been in the home on numerous occasions since 2004; the last time being on August 27, 2007.
AFFIDAVIT: An excessive amount of chemicals was seen inside the garage. The caller did not have details about this.
FACT: There were two gas cans in the garage; they were left outside and stolen.
FACT: One contained mixed gas for weed eater and the other contained gas for lawnmower.
FACT: One can of 3-36 multi-purpose lubricant.
FACT: Two empty containers of anti-freeze used for water to keep van from overheating.
FACT: Mother’s attorney and the GAL for Older Brother, showed up at home unannounced, on Saturday, 9/22/07.
FACT: Attorney said he is receiving conflicting reports and he needed to see for himself.
FACT: Attorney took pictures and was livid at this report and requested an extension so that he can better prepare for the hearing.
FACT: The unwarranted invasion of the family’s privacy on 10/11/07, by CPS drug investigator, Chuck Paul, when only minors were present, caused Chuck Paul to become ”infuriated at this waste of his time,” and used several expletives to express his outrage at caseworkers to two minors.
FACT: These allegations were presented to Judge Montemayor in Affidavit Form and worker, Regina Lenoir states she is of sound mind and able to swear to these allegations as personal knowledge.
FACT: Lenoir does not appear to be of sound mind, or she is a habitual liar.
FACT: Worker swears of personal knowledge of allegations wherein she repeatedly states, “It is unknown.”
FACT: Thursday, 9/13/07, Regina Lenoir showed up at mom’s home and said she needed to do a well child check but did not know which child she needed to check on.
FACT: Mom asked if Regina Lenoir had a warrant.
FACT: Regina Lenoir said “no” and that she “just wanted to look around.”
FACT: Mom told Regina Lenoir No, we are eating dinner.
FACT: Lenoir became so angry she threw a fit in the front yard, ripping her own head band off and leaving a huge chunk of hair extensions in mom’s front yard!
FACT: Mom has Lenoir’s hair in a plastic bag
FACT: Mom took bag with Lenoir’s hair to Judge Montemayor to prove how these workers are behaving.
The CPS investigator presented FALSE information in the Affidavit, sworn and signed by the investigator as evidence in a Suit Affecting the Parent Child Relationship. Title 5 of the Texas Family Code.
ReplyDeleteI'm sure Judge Montemayor was not informed the trusted CASA and CPS workers requested Montemayor grant a warrant to remove the children from each child's different public school.
The Affidavit Swears: "The children are home-schooled due to being kicked out of school."
FACT: Three males were only schooled in private, out of sight, schools while in foster care; not previously home-schooled.
FACT: All children are registered and attend public school.
FACT: Older Brother & Older Sister attend Karen Wagner H.S.
FACT: Andrew and Dustin attend Henry Metzger Jr. High.
FACT: Kristopherson attends Olympia Elementary School.
FACT: July 30, 2007 – school is not in session.
FACT: Caseworker left court, and with police assistance, drove to children’s separate schools. If she actually believed "All children ... [...] due to being kicked out of school," logic dictates the CPS agent retrieve the boys from "home school."
